For me, the terminator gene is a non-issue. Infact, if a GM product is to be marketed, it should have a terminator gene The rationale is twofold: 1) the marketed product becomes exclusive and comprehensive (no more suing farmers); and 2) there is no biodiversity repercussions.
However, given the existence of a terminator gene, farmers should be guaranteed the right to save seeds. The solution is mutually exclusive: restrict rights OR allow the creation of a pure private good.
